"Felony Driving Under the Influence" or "Drunk Driving"

BASIC DEFINITION: "Felony DUI" or "Felony Drunk Driving" in South Carolina is legally defined as any driver who -- while materially affected by excessive alcohol consumption, drugs, prescription medication, or any combination of these three – breaks traffic laws while driving a motor vehicle and then causes great bodily injury or death to another person.

CRIMINAL PENALTIES:

"Felony DUI – Great Bodily Injury" Minimum mandatory – 30 days in jail, up to 15years in prison and a minimum fine of $5,100.

"Felony DUI – Death" Minimum mandatory – One year in prison, up to 25 years in prison and a minimum fine of $10,100.

LICENSE SUSPENSION: The actual term of jail or imprisonment, plus an additional 3 years.
